User Agreement

Welcome to e-Sulah.com ("eSulah", "Platform", "We", "Us", "Our"). By accessing, registering on, or using eSulah, you agree to be bound by this User Agreement. Please read it carefully before initiating or participating in any dispute-resolution process on our Platform.

1. Definitions

Platform

The web application, mobile application, software and digital infrastructure hosted at e-sulah.com.

User (You, Your)

Any individual, business entity, or authorized representative accessing or utilizing the Platform to resolve a dispute.

Dispute Resolution Professional (DRP)

Independent, third-party arbitrators, mediators and conciliators empaneled on the Platform to facilitate dispute resolution.

Active Dispute

Any disagreement, claim or controversy formally registered and currently undergoing resolution on the Platform.

Arbitral Award

The final, binding decision rendered by an Arbitrator under the Arbitration and Conciliation Act, 1996 and its amendments.

Settlement Agreement

A mutually agreed-upon resolution documented and signed by the disputing parties following successful mediation or conciliation.

2. Acceptance of terms

By creating an account, submitting a dispute, or participating in a hearing on eSulah, you acknowledge that you have read, understood and agreed to this User Agreement — alongside our Privacy Policy and Terms & Conditions. If you do not agree, you must immediately cease using the Platform.

3. Platform role (the neutrality clause)

eSulah is solely a legal technology facilitator. We provide a secure, structured digital environment for parties to resolve their disputes efficiently.

No legal representation

eSulah is not a law firm. We do not provide legal advice, legal representation, or pass judgment on the merits of your case.

Independent neutrals

All DRPs (arbitrators, mediators and conciliators) are independent third-party contractors. They do not act as employees or agents of eSulah.

Absolute neutrality

The Platform does not advocate for any User and maintains strict neutrality in all Active Disputes.

4. Legal framework & enforceability

The services provided on eSulah operate strictly within the bounds of Indian law.

Arbitration

Conducted under the Arbitration and Conciliation Act, 1996. Arbitral Awards generated through eSulah are legally binding and enforceable as a decree of a civil court.

Mediation & Conciliation

Conducted in compliance with the Mediation Act, 2023 and relevant provisions of the Code of Civil Procedure, 1908. Settlement Agreements reached voluntarily by parties are legally binding and enforceable.

5. Scope of services & eligibility

5.1 Permitted services

eSulah facilitates the following Alternative Dispute Resolution (ADR) processes:

  • ·Online case consultation & notice generation
  • ·Online mediation & conciliation
  • ·Fast-track documentary arbitration
  • ·Virtual arbitral hearings

5.2 Non-arbitrable disputes

The Platform cannot be used for disputes that are not legally arbitrable or mediable in India. You may not submit disputes involving:

  • ·Criminal offences and penal matters.
  • ·The Platform facilitates mediation for matrimonial disputes strictly limited to financial settlements and maintenance arrangements. The Platform does not provide services for the adjudication of divorce, child custody, or any matters requiring a decree from a Family Court — except where such mediation is performed as a pre-litigation step recognised by law.
  • ·Insolvency and winding-up proceedings.
  • ·Eviction or tenancy matters strictly governed by rent-control statutes.
  • ·Any matter exclusively reserved for a specialised public tribunal or statutory body.

6. User conduct & evidence

To maintain the integrity of the ODR process, Users must adhere to the following standards:

Accuracy of information

You must provide true, accurate and complete information regarding your identity and your claim.

Untampered evidence

All documents, contracts, emails and files uploaded must be authentic and unaltered. Submitting forged documents will result in immediate termination of your account and potential legal action.

Decorum

You must maintain respectful and professional behaviour toward the opposing party, the DRP and eSulah staff during all chat negotiations and virtual video hearings. Abusive language or intimidation is strictly prohibited.

7. Confidentiality & privacy

7.1 The 'without prejudice' rule

All mediation and conciliation proceedings on eSulah are strictly confidential and conducted on a "without prejudice" basis. Statements made, documents shared specifically for settlement and settlement offers are legally privileged and inadmissible as evidence in any subsequent court or arbitral proceeding.

7.2 Data security

Case data, uploaded evidence and case transcripts are stored securely in eSulah's digital repository using industry-standard encryption. Access is restricted exclusively to the disputing parties, the assigned DRP, and essential administrative personnel.

8. Payments, fees & refunds

Upfront fees

All consultation / course fees must be paid in advance via our secure payment gateway before a dispute is actively processed.

No refunds

Once a DRP is appointed and the ADR process has commenced, fees are non-refundable — regardless of whether a settlement is reached, or the User withdraws their claim. A course refund will be issued only if the student is not eligible for the course after paying the fees.

Non-payment

Failure to pay required fees or clear invoices will result in the suspension of the dispute-resolution process and the withholding of final Settlement Agreements or Arbitral Awards.

9. Technical disclaimers

While we strive for a seamless digital experience, ODR relies on external digital infrastructure.

No liability for outages

eSulah is not liable for disruptions, delays or procedural interruptions caused by local internet outages, power failures or crashes of the User's personal devices.

Platform uptime

We do not guarantee 100% uninterrupted access to the Platform. Scheduled maintenance will be communicated in advance, but emergency downtime may occur.

Virtual hearing failures

If a virtual hearing is disconnected due to connectivity issues on the User's end, the DRP retains the discretion to reschedule the hearing or proceed based on documentary evidence, subject to procedural fairness.

10. Limitation of liability & indemnity

Limitation of liability

To the maximum extent permitted by law, eSulah (and its directors, employees and affiliates) shall not be liable for any direct, indirect, incidental or consequential damages resulting from the outcome of any dispute, the enforcement of any Award, or the actions/omissions of any DRP.

Indemnity

You agree to indemnify and hold harmless eSulah against any claims, damages, legal fees or liabilities arising from your breach of these Terms, your submission of fraudulent evidence, or your violation of any third-party rights.

11. Governing law & dispute resolution

Governing law

This User Agreement and your use of the Platform shall be governed by and construed in accordance with the laws of India.

Disputes regarding this agreement

Any dispute arising between You and eSulah specifically concerning this Agreement (excluding the underlying disputes between Users) shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
