1. Introduction & acceptance of terms
Welcome to eSulah. These Terms & Conditions govern your use of the eSulah website, platform and Online Dispute Resolution (ODR) services. By registering an account, filing a case, or participating in any proceeding on our platform, you agree to abide by these terms. If you do not agree with any part of these terms, please do not use our services.
2. Nature of the platform (we are not a law firm)
eSulah is a technology platform designed to facilitate alternative dispute resolution. We are not a law firm, and we do not provide legal advice, legal representation, or solicit clients for lawyers. We simply provide the digital infrastructure and administrative support to connect disputing parties with independent, certified Neutrals (Mediators and Arbitrators). Any advice or awards given during the proceedings come strictly from these independent experts, not from eSulah.
3. User eligibility and accounts
To use eSulah, you must be at least 18 years old and legally capable of entering into a binding contract under the Indian Contract Act, 1872. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you are representing a business or enterprise, you confirm that you have the legal authority to bind that entity to these Terms.
4. The dispute resolution process
By initiating or agreeing to participate in a case on eSulah, you understand that:
This is a voluntary process. The Mediator helps parties reach a mutual agreement (Sulah), but does not force a decision upon anyone.
If parties agree to arbitrate, the process is governed by the Arbitration and Conciliation Act, 1996 along with all its amendments. The Arbitrator's final decision (Arbitral Award) is legally binding and enforceable in Indian courts as a decree.
All hearings, document submissions and communications will take place digitally through the eSulah platform.
5. Role and independence of Neutrals
The Arbitrators, Mediators and Case Managers on our Panel of Neutrals are independent professionals, not employees of eSulah. They are bound by strict codes of ethics, neutrality and confidentiality. eSulah does not influence, dictate or alter the legal opinions, settlement terms, or Arbitral Awards passed by these Neutrals.
6. Fees and payments
Using the eSulah platform incurs specific administrative and neutral fees, which are clearly displayed before you initiate a service (such as booking a consultation or filing a dispute). Consultation fees must be paid in advance via our secure payment gateways. Any other fees will depend on the nature of the case. Unless expressly stated in our Refund Policy, all fees paid for dispute resolution services and consultations are non-refundable once the process has been initiated or the Neutral has been assigned.
7. User conduct and confidentiality
Dispute resolution requires respect and privacy. As a user, you agree to:
- ·Maintain the absolute confidentiality of all proceedings, documents and settlement discussions. You may not record, screenshot or publish any part of a mediation or arbitration session.
- ·Treat the opposing party, our Case Managers and the Neutrals with respect. Abusive language, harassment or threats will result in immediate suspension from the platform.
- ·Submit genuine documents. Uploading forged evidence or deliberately misleading the Neutral is a violation of these terms and Indian law.
8. Limitation of liability
While we strive to provide a seamless, secure technological experience, eSulah is purely a facilitator. We are not liable for the outcome of your dispute, the legal enforceability of your specific contract, or the actions/decisions of the independent Neutrals or the opposing party. To the maximum extent permitted by Indian law, eSulah and its affiliates will not be liable for any indirect, incidental or consequential damages resulting from your use of the platform.
9. Intellectual property
All content on the eSulah website — including text, graphics, logos, platform design and software — is the property of eSulah and is protected by Indian copyright and trademark laws. You may not copy, modify or distribute our intellectual property without our express written permission.
10. Account suspension and termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or disrupted the peace and neutrality of the ODR process.
11. Governing law and jurisdiction
These Terms & Conditions are governed by the laws of India. Any disputes arising out of your use of the eSulah platform (independent of the ODR cases you file) shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
